The terms on which Hyperion Hospitality arranges your booking, and on which you use this website.
1.1 These terms apply to every booking made with Hyperion Hospitality Ltd (“Hyperion”, “we”, “us”), a company registered in England and Wales under company number 03062319, with its registered office at 7 Prescott Place, London, SW4 6BS. They also apply to your use of this website.
1.2 “You” means the person or organisation making the booking. “Guests” means anyone attending under your booking. “Event” means the occasion your booking relates to. “Supplier” means any venue, organiser, rights holder, hotel, transport operator or other business that provides part of what we arrange.
1.3 If you book on behalf of an organisation, you confirm that you have its authority to do so.
2.1 Hyperion arranges access to events, together with the hospitality, travel and services around them. We do not stage events or operate venues.
2.2 We secure tickets, hospitality and related services from Suppliers on your behalf. Each Supplier’s own terms, conditions of entry and venue rules apply alongside these terms, and we will share any that are relevant to your booking.
2.3 Descriptions, images and itineraries on our website and in our proposals give a general picture of each experience, and images may be illustrative. The details confirmed to you in writing are the ones that apply to your booking.
3.1 A booking is confirmed only once we have sent you written confirmation and received any deposit due. Until then, neither of us is committed and availability is not guaranteed.
3.2 We may decline any enquiry or booking at our discretion.
3.3 Prices are quoted in pounds sterling, with VAT shown where it applies. The price in your booking confirmation is the price you pay, unless a government changes a tax or levy after confirmation, or your confirmation states that part of the price depends on a Supplier’s currency or published fare.
3.4 If we make an obvious error in a price or description, we will tell you as soon as we notice it. You may then either proceed at the correct price or cancel that item for a full refund of anything you have paid for it.
4.1 Unless your booking confirmation says otherwise: (a) bookings made nine months or more before the Event require a 25% deposit, with the balance due 12 weeks before the Event; (b) bookings made between four and nine months before require a 50% deposit, with the balance due 12 weeks before; and (c) bookings made less than four months before are payable in full at the time of booking.
4.2 Tickets, passes and travel documents are released only once full payment has cleared.
4.3 If a payment is late, we may treat your booking as cancelled by you, in which case section 5 applies. For business clients, we may also charge interest on overdue sums at 4% a year above the Bank of England base rate.
5.1 Please tell us in writing if you wish to cancel. Because we commit funds to Suppliers on your behalf, your deposit is non-refundable once your booking is confirmed.
5.2 If you cancel before the balance is due, we will keep your deposit, and you will pay any further costs we have already committed to Suppliers and cannot recover. If you cancel after the balance is due, the full price is payable.
5.3 Where a Supplier allows, we will try to resell or reallocate cancelled places, and we will credit you with anything we recover, less any reasonable costs.
5.4 Guest names can usually be changed up to the deadline set by the Supplier. Additional places are subject to availability and to the price at the time.
5.5 Bookings for events and leisure services on a specific date are not covered by the 14-day cancellation right under the Consumer Contracts Regulations 2013.
6.1 Events are run by their organisers, and dates, times, venues, line-ups and running orders can change. Changes of this kind, including a change of seat or area within the same category of hospitality, do not entitle you to cancel.
6.2 If an Event is cancelled, postponed, moved, held behind closed doors or held with reduced capacity, we will pass on to you in full any refund, credit or replacement the relevant Supplier provides, and we will help you choose between the options available.
6.3 If an Event is postponed, your booking will normally transfer to the new date. If you cannot attend on the new date, we will request a refund from the Supplier on your behalf, but whether one is available depends on that Supplier’s terms.
6.4 If an Event goes ahead but a Supplier cannot provide part of what you booked, we will arrange something of equivalent value where we can, or refund the part that could not be provided.
6.5 Neither of us is responsible for any failure caused by circumstances outside reasonable control, such as severe weather, industrial action, public health measures, security incidents, or decisions by a government or an organiser.
7.1 We may cancel a booking if you do not pay on time, if you seriously breach these terms, or if your organisation becomes insolvent. In these cases, section 5 applies as though you had cancelled.
7.2 If we cancel for any other reason within our control, we will refund everything you have paid us.
8.1 Tickets and hospitality are for you and your Guests only. They may not be resold, transferred for profit, offered as a prize or charged for. Organisers can cancel tickets used in this way, and no refund will be due.
8.2 You are responsible for your Guests, and for making sure they know the details of the Event, including dress codes, age restrictions, identification requirements and arrival times.
8.3 Venues may search guests, refuse entry, or remove anyone who breaches their rules or behaves unacceptably. No refund will be due where this happens.
8.4 Please tell us about any accessibility or dietary requirements when you book, and we will pass them on to the Suppliers concerned.
9.1 Where we arrange chauffeured transfers, rail journeys, flights or accommodation, we book them on your behalf with the operator or hotel concerned, and that operator’s terms apply.
9.2 You are responsible for holding valid passports, visas and any other documents needed for travel.
9.3 We strongly recommend comprehensive travel and event insurance, including cover for cancellation.
10.1 We will arrange your booking with reasonable care and skill.
10.2 We are not responsible for the acts or omissions of Suppliers, or for any loss that was not reasonably foreseeable when your booking was made. For business clients, we are not responsible for any loss of profit, business or opportunity.
10.3 Our total liability for any booking is limited to the price you paid us for it.
10.4 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your statutory rights as a consumer.
10.5 Guests are responsible for their own belongings at every Event.
11.1 We treat every client relationship with discretion. We do not share details of your bookings with anyone outside Hyperion, other than the Suppliers who need them to deliver your booking, or where the law requires it.
11.2 Our proposals, pricing and arrangements are prepared for you alone, and we ask that they are not shared with third parties without our agreement.
11.3 The content of this website belongs to Hyperion Hospitality Ltd or its licensors and may not be copied or reproduced without our written permission.
12.1 If something is not right, please tell us as soon as possible, at the Event where you can, or by email to enquiries@hyperionhospitality.co.uk. We will acknowledge your complaint within two working days and aim to resolve it within 14 days.
12.2 You may not transfer your booking, or your rights under these terms, to anyone else without our agreement.
12.3 If any part of these terms is found to be unenforceable, the rest will continue to apply. If we do not enforce a term straight away, we may still enforce it later.
12.4 We may update these terms from time to time. The version on our website when you make your booking applies to that booking.
12.5 These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
